1. Merchant Cash Advance — Not a Loan

MRCHNT Funding does not provide loans. The products offered by MRCHNT Funding are merchant cash advances (MCAs), which involve the purchase of a specified amount of a business's future receivables at a discount. A merchant cash advance is a commercial transaction and is not subject to state or federal lending laws governing consumer loans, interest rates, or annual percentage rates (APR). You should not evaluate the cost of a merchant cash advance using APR or other loan-based metrics.

2. Factor Rate Disclosure

The cost of a merchant cash advance is expressed as a factor rate (also referred to as a buy rate), not an interest rate. A factor rate is a fixed decimal figure (e.g., 1.20 to 1.49) applied to the purchased amount to determine the total payback amount. The factor rate is agreed upon at the time of contract execution and does not change regardless of how quickly or slowly the advance is repaid. Because the total repayment amount is fixed, early repayment does not reduce the cost of the advance.

3. Withholding and Repayment

Repayment of a merchant cash advance is made through a specified withholding percentage of the business's daily or weekly receivables or gross revenue, typically via ACH debit from the business's bank account. The withholding percentage is agreed upon at the time of contract execution. Because repayment is tied to actual revenue, daily or weekly remittance amounts may fluctuate with business performance. However, the total payback amount remains fixed at the contracted amount.

Providing ACH access to your business bank account is required as a condition of funding. MRCHNT Funding will only debit amounts in accordance with the agreed-upon withholding schedule.

4. No Guarantee of Approval or Funding Amount

Submitting an application does not guarantee approval. All applications are subject to underwriting review, which considers factors including but not limited to monthly revenue, time in business, industry type, bank account activity, and existing financial obligations. MRCHNT Funding reserves the right to approve, modify, or decline any application at its sole discretion. Approved advance amounts and factor rates may differ from amounts requested.
